Orders

All orders are subject to acceptance and availability. We will notify you by e-mail as soon as possible to acknowledge receipt of your order and to provide you with an order number. If we are unable to fulfil your order following this acknowledgement, we will contact you by e-mail or telephone advising you of this. We will confirm acceptance of your order by sending you an e-mail that confirms that the Products have been dispatched ("Dispatch Confirmation"). A legally binding contract between us will be formed when we send you the Dispatch Confirmation (or, in the unlikely event that a Dispatch Confirmation is not sent due to a processing error, when we dispatch the Products to you) ("Contract"). If you require any information concerning your order, please Contact us during business hours, quoting your order number. We may not accept your order if a Product you have ordered is out of stock, if we have identified a Product or pricing error, or if we are unable to obtain authorization for your payment. Please note that we reserve the right to reject any offer to purchase by you at any time.

Cancellation Rights

As you are a consumer, you have a legal right to cancel a Contract under the Consumer Contracts Regulations 2013 from the date of the Dispatch Confirmation until the date which is fourteen (14) days after you receive the Products. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the Contract and receive a refund.

Your right to return Products does not apply to Products (i) made to your specification; or (ii) which have been clearly personalised; or (iii) which by reason of their nature cannot be returned or are liable to deteriorate or expire where sealed Products have been supplied which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery.

 To cancel a Contract, you just need to let us know that you have decided to cancel. The easiest way to do this is to Contact us  during business hours. In any such written communication, you must include details of your order, including your order number, to enable us to identify it. Your cancellation is effective from the date you send us the e-mail or phone us

You must return it to us in its original packaging without undue delay and in any event no later than fourteen (14) days after the day on which you let us know that you wish to cancel the Contract.

You should have regard to any labelling and packaging guidelines produced by Royal Mail or any other courier used.

Unless the Product is faulty or not as described, you will be responsible for the cost of returning the Products to us.

If sending by post, we recommend that you obtain proof of postage as we do not accept responsibility for items lost in transit; and

If you cancel your order but do not return such Products to us within fourteen (14) working days of notifying us of cancellation, we shall be entitled to withhold payment of any refund.

In the event of an international delivery where you have been charged local taxes on the Products you wish to return; you will need to approach your local customs office and present proof of return in order to reclaim any taxes paid.

We will refund you on the credit card or debit card used by you to pay. If you used vouchers or loyalty points to pay for the Products, we may refund you in vouchers or loyalty points.

Price and Payment

We have taken great care in the preparation of the content of this Website, in particular to ensure that the details, descriptions and prices quoted are correct at the time of publishing. However, we will only accept orders if there are no material errors in the description of the Products or the prices as advertised on this Website. All prices are displayed including VAT and exclusive of delivery charges. The total cost of your order is the price of the Products ordered plus VAT at the current rate and plus the delivery charges as set out during the checkout process.  We may not accept your order if a Product you have ordered is out of stock, if we have identified a Product or pricing error, or if we are unable to obtain authorization for your payment. Please note that we reserve the right to reject any offer to purchase by you at any time.

You must pay for all Products and Services in advance. We accept payment via the methods stated on the order page.

We do not charge your credit or debit card until we dispatch your order. Items in your online Shopping Cart will reflect the most recent price displayed on the Product's detail page.

You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorize payment to us we will not be liable to you for any delay or non-delivery.

Prices may change without notice. Import duties and taxes for international (Northern Ireland, France and Germany) deliveries are the responsibility of the customer.

We do not guarantee, represent or warrant that your use of our Services will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Services will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Services is at your sole risk. In no case shall LG H&H, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Services or any Products procured using the Service, or for any other claim related in any way to your use of the Services or any Product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

 Eligibility to Purchase

To be eligible to purchase Products on this Website and lawfully enter and form Contracts on this Website under English law you must, if an individual, be 18 years of age or over; and register your real name, address, phone number, e-mail address any other details requested. By offering to purchase Products and Services you represent to us that you are 18 years of age or over and authorize us to transmit information (included updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.

Severance

If any part of the Terms & Conditions is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Entire Agreement

These Terms & Conditions form the entire basis of any agreement between you and us.

Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes will be decided only by the English courts.

Returns

We offer a comprehensive returns policy in the unlikely event that you are not 100% satisfied with any Product delivered. Please note that the following returns procedure must be followed and failure to do so may result in us being unable to provide refunds. Also please be aware that we cannot be held responsible and provide refunds on stock affected by circumstances beyond our control. This includes damage and neglect after Products are received, Products being stored in climatic conditions and damage by third parties.

Should you wish to return a Product for any reason please notify us within forty-eight (48) hours of receipt of your order of any part that is unsatisfactory. In order to arrange a return please contact us, inform our customer service team of your order number, the item you are returning, and the reason for the return. We will then reply with a unique returns authorisation number and the address you need to send the item to.

You'll need to package the item securely and include:

• Your order number
• The returns authorisation number
• Whether a replacement or refund is needed
• The reason why you are returning the item
• Products returned should be in their original condition and packaging in which they arrived along with a copy of the invoice or packing slip.

Once received Products will be checked and refunds on Products and postage will be arranged where suitable. With respect to certain Products on sale, we cannot issue refunds on simply unwanted Products due to the perishable nature of Products on sale. Refunds for the defective Products will only be offered on Products that are faulty and were clearly so at the time at which they were delivered. Please note that original delivery charges are not refunded, LG H&H will refund your payment for the Products as soon as possible by the original payment method, no later than twenty-one (21) working days after we have received the Products.  

Competitions and Prize

From time-to-time LG H&H will run competitions, free prize draws and promotions on this Website. These may be subject to additional terms that will be made available at the time.

Prize draws are open to residents to be age 18 or over of the UK, except employees of LG H&H, the promoter and their immediate families and anyone else connected with the creation and administration of the promotion. Prizes are non-transferable, non-negotiable and no cash alternatives will be offered. LG H&H reserves the right to substitute the prize for another prize of equal value. No purchase is necessary to enter the competitions unless otherwise stated on the promotional activity with a specific competition.

By entering the promotion, the winner(s) consent to any publicity generated as a result of the promotion, and use on websites, magazines or mobile services at any time. The Website editor's decision is final and no correspondence will be entered into. Odds of winning depend on the number of eligible entries received. Only (1) entry per person. Spammers will be disqualified.

LG H&H will not accept responsibility for loss through technical fault or incomplete, illegible or other damaged entries. Proof of entry is not automatically proof of receipt.

The winner of a prize will be notified within twenty-eight (28) days after the winner has been ascertained.

Please allow twenty-eight (28) days for delivery of all prizes.

If the winner of the a competition is unable to take up a prize for any reason or if the winner cannot be notified after reasonable efforts having been made then we may dispose of the prize as we think fit without any liability to the winner for having done so.

For each competition, only one (1) prize will be awarded per entrant / email address. Names of winners will be available on request.

Claiming Prizes

Prizes involving Travel: (a) Travel arrangements are the responsibility of prize winners unless otherwise stated; (b) we reserve the right to require written permission from the parent or guardian of any winner who is under the age of 16 and to require such a winner to choose as a companion someone 18 or over.

Competition prizes/tickets may be restricted to certain times of the year and unless otherwise stated all prizes must be taken within six (6) months of the date of the competition draw.

Where prizes are to be provided by a third party then the winner will be required to complete all appropriate or applicable booking or other formalities direct with such providers. We will have no responsibility for the acts/defaults of any other persons or companies.

Reviews

If you submit a review, to the fullest extent permitted by applicable law, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media, including in our marketing materials. You acknowledge that your review is public, for everyone to see, use, copy, and share, and we have no obligation, but reserve the right to monitor, flag, delete or refuse to reproduce any review we believe may be in violation of this Terms & Conditions. Under no circumstances, we will be liable in any way for any loss of any review. We do not endorse any review, or any opinion, recommendation or advice expressed therein, and we disclaim all liability with respect to the content posted by third parties.

You grant us and its sub-licensees the right to use the name that you submit in connection with such content, if we or our sub-licensees choose.

You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.

You agree to perform all further acts necessary to perfect any of the above rights granted by you to us, including the execution of deeds and documents, at the request of us.

You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to the Website; the content and material you provide is accurate; use of the content and material you supply does not breach any applicable our guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify LG H&H for all claims brought by a third party against LG H&H arising out of or in connection with your review and/or a breach of any of these warranties.

Gift With Products Promotions

Where we are offering a free gift with a Product, we shall only provide one (1) free gift per transaction (irrespective of how many Products are purchased). The free gift is subject to availability, and we reserve the right to change the free gift for an alternative gift.

In order for us to facilitate the provision of a free gift, it may be necessary for us to include the free gift on our Website at a nominal value. For the avoidance of doubt, you are not entitled to 'purchase' the free gift without purchasing a Product and any attempt to 'purchase' the free gift will be cancelled (notwithstanding any automated communication you may receive acknowledging your order). In the unlikely event that the free gift is dispatched to you, you shall be obliged to return the free gift upon written request.

Free Gifts

The gift on offer is correct at time going to print. Gifts are limited in quantity and LG H&H reserve the right to remove the offer once the gift has run out. In order to qualify for the gift, customers must meet the minimum purchase requirements stipulated on the offer.

Once the free gift has run out, the offer will be removed from the Website.

If a customer for any reason decides to return the qualifying product, the free gift must also be returned.

Referral Scheme

Subject to the terms set out below, you may earn ‘credit’ for use on this Website by referring a new customer(s) to us through our referral scheme by sharing the referral link and/or referral code we provide to you (the “Referral Scheme”). You are only eligible to participate as a ‘referrer’ in this Referral Scheme if you have previously placed an order on the Website.

A new customer is a natural person who has not previously placed an order with us (a "Referee"). If the Referee has an account on the Website but has not previously placed an order on the Website then they are entitled to participate in the Referral Scheme through the ‘referral link’ only. If the Referee already has an account on the Website then they will be unable to participate in the Referral Scheme using a ‘referral code’ (regardless of whether they have previously placed an order).

If the Referee has clicked through your referral link the discount code will automatically be applied at checkout. If the Referee is using a referral code, the Referee must enter this code at checkout.

For the avoidance of doubt, any credit generated from the Referral Scheme may only be spent on the Website and neither you nor the Referee is entitled to receive any payment of any kind in respect of the credit. The credit is not redeemable for cash. The credit that stands to your Referral Scheme account is not transferable in any way.

Any credit accrued through the Referral Scheme that has not been used within 12 months from the date of accrual will expire.

The Referee must place an order with a value of at least the minimum value as stated on the Website from time to time.

We may, in our sole discretion, withdraw your credit generated from the Referral Scheme at any time if we believe or suspect that your use of the Referral Scheme is fraudulent, misleading or contrary to these Terms & Conditions.
